Work permit process - H1, L1

H-1B visa is a US visa processed for an alien temporary non-immigrant worker in a specialty occupation.

Below are the criteria to qualify for H-1B:

H-1B visa can be processed if a person possesses Mechanical / Production / Civil / Chemical / Electrical / Electronics and Communication / Instrumentation / Computer science bachelor’s degree in the given specialty occupation and have work experience deemed equivalent to such a degree (3 years work experience equivalent to 1 formal year of education)

  • Minimum 6 years of total relevant work experience is mandatory for Diploma holders / BSC graduates / B.Com graduates (12th + 3 years graduation)
  • Minimum 3 years of total relevant work experience is mandatory for other graduates having 16 years of formal education (12th + 4 years graduation)
  • Minimum 6 months validity of passport
  • Employee Back ground verification status to be green

Category: H1 cap (USCIS accepts H1 cap applications from 1st April every year and will accept till the quota of 65000 applications is reached)

H1 transfer (People who are working in the U.S. on H1 status are eligible for H1 transfer and can start working for new employer once H1 is filed with USCIS)

H1 extension (To extend I-94 status at onsite to continue employment with same employer)

H1 cap exempt (People who have got approved H1 in last 6 years and currently residing out of USA will qualify for H1 exempt category and they are exempt from H1 cap)

H1 amendment (People who relocate to new work location in the U.S. are required to file H1 amendment)

L1 Work Permit

The L-1 visa is available to Intra-Company Transferees who have been outside of the US for at least one of the prior three years. “L� visa holders are exempted from the requirement of having to establish their continued non-immigrant intent, greatly smoothing the progress of the transition to an immigrant employment based visa, leading to a “green card�. L-1 visas are available to transfer executives, managers, or Applicants with specialized knowledge.

Mandatory criteria for applying for L1s

  • It is a mandatory requirement that the beneficiary’s day to day work activities are controlled and supervised by onsite employer person at onsite.
  • The assignment/engagement should not be merely to provide labor for the client organization rather it should be provision of a product or service for which specialized knowledge specific to the petitioning employer is necessary
  • All L applicants must have worked for the employer abroad for at least 1 year excluding B visits in the last 3 years.

There are two types of employees who may be sponsored for USA L1 visas:

  • Managers/Executives

The legal definition of management and executive roles for these purposes is quite strict, and a detailed description of the duties attached to the position will be required. In particular, the executive or manager should have supervisory responsibility for professional staff and/or for a key function, department or subdivision of the employer. Such personnel are issued an L1A visa, initially for a three year period extendible in two year increments to a maximum of seven years.

  • Specialized Knowledge Staff

This category covers those with knowledge of the company's products/services, research, systems, proprietary techniques, management, or procedures. Staff in this category is issued an L1B visa, initially for three years extendible to a maximum of five years.
